GENERAL TERMS AND CONDITIONS OF BUSINESS

If you would like to become a customer or active user of our website, please read our General Terms and Conditions (hereinafter: GTC) carefully. We also ask you to use our services only if you agree to all points of the General Terms and Conditions and accept them as binding on you.

If an order is placed via the online shop, the customer accepts the current general terms and conditions of BULLBIKE (hereinafter: GTC) at the same time as placing the order. The current general terms and conditions can be found and viewed on the website www.bullbike.at under the menu item General Terms and Conditions. If you have any questions about the operation of the online shop, the ordering and delivery process, please do not hesitate to contact us using the contact details provided.

  1. General Provisions

 

In matters not regulated in these Terms and Conditions, Hungarian law applies, in particular Act V of 2013 on the Civil Code, Act CVIII of 2001 on Certain Issues of Electronic Commercial Services and Services Related to the Information Society. Act and 45/2014 on the Detailed Rules for Contracts between the Consumer and the Entrepreneur. (II.26.) Relevant provisions of the Government Decree.

These Terms and Conditions are valid from January 20, 2024 until they are cancelled. The Service Provider is also entitled to change the Terms and Conditions unilaterally. The Service Provider will publish the changes on the Website before they come into effect. If any part of these Terms and Conditions is invalid, illegal or unenforceable, this will not affect the validity, legality and enforceability of the remaining parts.

The contractual language of these General Terms and Conditions is Hungarian.

  1. Registration

Registration is required to purchase. Registration is free. After registration, you can log into your account using your email address and password.

You are responsible for the data collected during registration. We reserve the right to refuse registration without giving reasons or to revoke it at any time if the General Terms and Conditions are violated. The General Terms and Conditions contain the conditions and information that must be observed and applied when using the online shop.

Data protection:

When handling the data transmitted to us during registration, we ensure that it is used in accordance with the law in all phases of the application. When managing and processing personal data, we pay particular attention to the CXII of 2011 on the right to self-determination and freedom of information. Right to respect and always comply with the relevant provisions of the applicable data protection law.
We store our customers' data for contract processing and for later review of the contract conditions. We archive incoming orders and treat them as written contracts that can be accessed later.

Our customers' data will be deleted when the registration is cancelled and stored for the duration of the registration.

We do not transfer the personal data of our registered customers to third parties, with the exception of the inclusion of our customers' data in the database of our logistics center, to which the registered customer expressly consents, as well as the delivery of the customer's delivery address and telephone number to the courier in case of an order, which is a prerequisite for successful delivery.

III. Command

You can start shopping by either logging into your account or, after entering your account, selecting the products you wish to purchase and adding them to your shopping cart.

Ordering process:

  1. Select the products you want to purchase and add them to your shopping cart.
  2. Select or specify the shipping and billing address, shipping and payment method by clicking the “Checkout” button in the shopping cart or by entering your account details.
  3. Finally, check the data you have entered and click on the "Submit order" button. It is important to make sure that the data you have entered is correct, as this is the basis on which the product will be delivered and invoiced.

Please note that orders are processed in the order in which they are received, so it may happen that the item you ordered is no longer in stock. In this case, our employee will contact you and inform you of the options. If we are unable to fully fulfill the order, you have the right to cancel the order immediately. Please notify us of the cancellation of the purchase in writing using one of the contact details provided.

The information displayed in the webshop is considered an invitation to submit an offer (not an offer).

The customer receives a confirmation of his order (offer). If this confirmation is not received by the customer on time, depending on the type of service, but no later than 48 hours after the customer has sent the order, the customer is released from the binding offer or the contractual obligation. The order and its confirmation are considered a written contract between the parties. The contract language is Hungarian. The place of conclusion of the contract is the respective registered office of our company. The orders placed in our web shop are stored in the BULLBIKE computer system and printed out and enclosed; they are available to the customer on request. The confirmation is only available to the consumer in electronic form.

Cancellation of the order is only possible with the consent of BULLBIKE.

  1. range of products available for purchase

In the webshop, the service provider displays the name and description of the product in detail and shows photos of the products. The images shown on the product sheet may differ from the actual ones and may be for illustrative purposes only. We are not responsible for the difference between the image shown in the webshop and the actual appearance of the product.

If, despite all due care on the part of the Service Provider, an incorrect price is displayed in the webshop, in particular with regard to obviously incorrect prices, e.g. for a price of EUR "0" or EUR "1", which deviates significantly from the known, generally accepted or estimated price of the product or which may occur due to a system error, the Service Provider is not obliged to deliver the product at the incorrect price, but can offer delivery at the correct price; upon knowledge of this, the Customer can abandon his intention to purchase.

  1. The right of withdrawal

Private ( consumer ) customer In accordance with Directive 2011/83/EU of the European Parliament and of the Council and the detailed rules for contracts between consumers and businesses 45/2014. (II.26.) he is entitled to the right of withdrawal in accordance with the Government Decree. The customer has the right to withdraw from the purchase within 14 days of receiving the goods without giving any reason. The consumer may exercise his right of withdrawal by making an unambiguous declaration to this effect or by 45/2014. (II.26.) using the declaration model provided in Annex 2 to the Government Decree or by using the model included in these SRH. In the case of written cancellation, the deadline is considered effective if the customer's declaration is sent before the deadline expires. The deadline for exercising the right of withdrawal expires 14 days from the day on which the consumer or a third party other than the carrier designated by him receives the product.

BULLBIKE is obliged to refund the amount paid by the consumer immediately, but no later than fourteen days after the cancellation.

The consumer shall bear the costs incurred in connection with the return of the product due to the exercise of the right of withdrawal. The consumer shall not incur any further costs. The consumer is obliged to return the goods to the service provider or deliver them to the service provider's address without undue delay, but no later than 14 days from the date of sending the declaration of withdrawal. This results from choosing a method of transport other than the method of transport. However, the company may demand compensation for damage caused by improper use of the product.

The right of withdrawal applies to all products returned to the store unopened or in opened but undamaged factory packaging. However, the right of withdrawal does not apply to products that are in such a condition that they cannot be sold as new. The consumer is only responsible for the depreciation resulting from use beyond that necessary to determine the nature, characteristics and functioning of the product.

A consumer is a consumer within the meaning of the German Civil Code.

BULLBIKE will inform the customer of the delivery time in the confirmation. The customer can withdraw from the contract at any time, but is obliged to pay BULLBIKE compensation.

  1. Prices, delivery information

The prices shown on our website are in EUR and always include VAT. The prices valid at the time apply to our binding offer. The prices indicated do not include the costs associated with delivery, which can be found under the Shipping Costs menu item. The prices charged for the product do not include the installation fee of our subcontractors, for which our subcontractors issue an invoice, the estimated amount of which we communicate to our customers on our website.

The prices are informative and can be changed before the contract is concluded. The price stated in the confirmation is valid until the end of our binding offer.

The fulfillment process usually takes 5-7 days, the buyer will be informed in the confirmation about the expected delivery time of the current order.

The order placed is considered valid upon sending the confirmation email.

VII. Terms of Payment

When ordering in our online shop, the customer can pay the purchase price in the following ways:
- Cash on delivery, - Bank transfer - Bank card.

to comply with the Civil Code. to pay interest on late payment in accordance with Section 6:48.

We reserve the right to refuse orders if the customer has an overdue debt to BULLBIKE.

VIII. Complaints, guarantees, warranties

We can accept warranty claims if you are in possession of the warranty certificate or, in the case of a product for which no separate warranty certificate has been issued, against an invoice proving the purchase of the product, in both cases with proof.

Warranty claims will be accepted against the invoice proving the purchase of the product, by drawing up a protocol. In any case, the goods must be returned to our headquarters.

Exchange obligation:

151/2003 on the mandatory guarantee for certain consumer goods. (IX. 22.) In the case of products covered by the Decree, if the consumer submits an exchange request due to the defect of the consumer product within three working days of purchase (putting into operation), the company cannot invoke the Civil Code (Ptk.) of 2013. to the provisions of Law V.

Guarantee:

Unless otherwise stated on the warranty card, Regulation 151/2003 on the mandatory guarantee for certain consumer goods applies. In accordance with Section 2 paragraph 1 of the Government Regulation (IX. 22.), we provide a 1-year guarantee on the products. The guarantee certificate (warranty certificate) supplied with the product contains, among other things, information on the buyer's rights and the deadline, place and conditions for exercising them.

During the warranty period, we undertake to replace or repair the defective product. Exchange is possible only if the product cannot be repaired. In the event that the noise level of the air conditioner does not meet the customer's requirements, but does not exceed the value specified in the technical specification of the device, which is confirmed by measurement - from the accepted measuring distance (defined by EUROVENT), then it cannot be considered a defect. In case repair and replacement are not possible, we can offer a replacement product. In case the customer does not accept this, we will refund the purchase price of the purchased product.

Further guarantee conditions are set out in Article 151/2003 (IX. 22.) Government Decree.

In case of unsatisfactory performance, you can assert a warranty claim against the company in accordance with the rules of the German Civil Code .

Within the scope of the accessories guarantee, the customer can request a repair or replacement delivery as a priority - at his or her discretion - unless this is impossible for any reason or would mean disproportionate additional expenditure for BULLBIKE compared to the fulfillment of another guarantee claim.

If repair or replacement delivery is not possible or if BULLBIKE has not carried out this or cannot do so, the buyer can demand an appropriate price reduction or withdraw from the contract. Cancellation due to an insignificant error is not possible.

The repair or replacement must be carried out within a reasonable period of time, taking into account the characteristics of the item and the intended use expected by the buyer, without causing significant inconvenience to the buyer.

If BULLBIKE does not remedy the defect or does not do so within a reasonable period of time, the customer can remedy the defect himself or have it done by someone else at the creditor's expense.

The buyer may withhold a reasonable portion of the payment until repair or replacement.

The buyer can switch from the chosen warranty right to another. He is obliged to compensate the creditor for the damage caused by the assignment, unless the assignment was caused by the creditor's conduct or the assignment was otherwise justified.

If the defect is discovered, the buyer must notify BULLBIKE of the complaint as soon as possible under the circumstances. In the case of a consumer contract, an objection raised within two months of the defect being discovered is considered timely.

The buyer can assert his warranty rights within a one-year limitation period from the provision of the service.

In the case of a consumer contract, the consumer can assert his warranty claim within a two-year limitation period from performance.

Further warranty conditions are set out in the Civil Code. 6:157.§ - 6:177.§.

Product warranty:

As a product warranty claim, the customer can only request the repair or replacement of the defective product.

The product is defective if it does not meet the quality requirements applicable at the time of placing on the market or does not have the properties described by the manufacturer.

You can assert your product warranty claim within two years of the manufacturer placing the product on the market. After this period, you lose this right.

You can only assert your product warranty claim against the manufacturer or distributor of the product. In the case of a product warranty claim, the buyer must prove the defect in the product.

You cannot make an Accessory Warranty claim and a Product Warranty claim at the same time due to the same defect. However, if your Product Warranty claim is successful, you will be able to make your Accessory Warranty claim against the manufacturer for the replaced product or repaired part.

The buyer cannot assert a secondary warranty claim or a product and warranty claim simultaneously and in parallel due to the same defect, otherwise the rights under the warranty will be granted independently of the rights defined within the scope of the warranty.

  1. assembly

The buyer is BULLBIKE You can order the installation (installation, commissioning) of the product sold, mediated by us and carried out by our subcontractors, via its website or via its telephone customer service, provided that the corresponding product has been purchased.

By placing an order, the Buyer confirms and accepts that all information in the order is correct and corresponds to reality and also declares that he has read and accepted the General Terms and Conditions of Purchase and Service.

The subject of the installation contract concluded with the subcontractor selected by us is the delivery, assembly and installation of the products ordered on the BULLBIKE website at the place and time agreed in advance with the customer, based on the order created. By accepting the order, the subcontractor undertakes the delivery, assembly and commissioning of the product purchased in the online store.

During the entire installation, the customer is obliged to provide the installation team with access to a power socket (230 V), a washroom, a toilet and running water. For technical reasons, installation must be carried out at a temperature of at least 18°C.

In addition, the Buyer must be present during the assembly or ensure the presence of his responsible representative (presence of a person over 18 years of age authorized by the Buyer), who will represent the Buyer during the assembly and can approve any changes. After assembly, the handover protocol is signed by the Buyer or the person carrying out the work. If the work is carried out for reasons within the Customer's sphere of interest or in the event of suspension due to circumstances caused by the Customer, the Subcontractor is entitled to a contractual penalty of EUR 100. Before starting the installation work, the Customer - without special request from the Company or its representative - informs the Subcontractor carrying out the installation all important information related to the installation. Before ordering, the Buyer must measure all dimensions. The Buyer can measure the dimensions himself. If the measurement is carried out by the Buyer, the Buyer bears full responsibility for the measurement and the accurate description of the data necessary for the installation. The customer shall ensure that the conditions and other data required for installation do not change between the time of inspection and installation in such a way that they affect the installation work and its feasibility.

If the installation can only be carried out at increased costs at the request of the customer or due to other circumstances that are not within the control of the assembly subcontractor, the subcontractor can only invoice the customer for the increased costs if the customer has been informed to report this immediately and to inform him of the amount of the costs. If the installation cannot be carried out in whole or in part for reasons that are in the interest of the buyer, the commissioned subcontractor is entitled to reimbursement of the costs incurred as a result of the circumstances and will pass these costs on to the buyer. If consumables or other parts required for the installation are not available at the installation site and the installation cannot therefore be carried out or completed, this is not considered a delay in the provision of the service. After completion of the work, the customer confirms with his written signature that the installation was carried out correctly.

In case of a dispute with the buyer's complaint, he may turn to the Pest County Arbitration Board.

The arbitration board is responsible for the out-of-court settlement of consumer disputes. The task of the arbitration board is to try to reach an agreement between the parties to settle the consumer dispute. If this is unsuccessful, it will make a decision on the matter in order to ensure a simple, quick, efficient and cost-saving enforcement of consumer rights.

In the event of a cross-border consumer dispute relating to an online purchase or online service contract, the proceedings shall be exclusively within the jurisdiction of the Conciliation Board of the Budapest Chamber of Commerce and Industry.
